Marshall MIGWANS - Drunk Driving, Speeding

(SERPENT RIVER FIRST NATION, ON) - On July 18, 2018, members from the East Algoma Ontario Provincial Police (OPP) were on patrol on Highway 17 within the Territory of Serpent River First Nation.



Shortly before 4:00 p.m., police observed an eastbound vehicle travelling at a high rate of speed. The officer attempted a vehicle stop with his emergency lights activated. The vehicle continued eastbound on Highway 17, then continued north onto Hillside Drive West. The officer then activated his sirens several times where the vehicle came to a stop at a dead end.



The officer queried the male driver who had a valid Ontario Class G1 driver's licence. While speaking to the male driver the officer determined the driver had been consuming alcohol. The driver was arrested and transported to Blind River Detachment.



As a result of the investigation, Marshall MIGWANS, 25 years of age from M'Chigeeng First Nation, Ontario was charged with:

Driving with More than 80 milligrams of Alcohol in Blood, contrary to section 253(1)(b) of the Criminal Code;
Class G1 Licence Holder - Unaccompanied by Qualified Driver, contrary to section 5(1) of Ontario Regulation 340/94 of the Highway Traffic Act (HTA); and with
Speeding, contrary to section 128 of the HTA.


The accused is scheduled to appear before the Ontario Court of Justice in Blind River on August 9, 2018.
